Richard A. Levine, 74, of Delray Beach, was arrested Monday and charged with attempted first-degree murder, aggravated battery with a deadly weapon and firing a weapon in public, according to Palm Beach County Sheriff’s Office Online booking records.

On Sunday at about 7 p.m. EDT, deputies arrived at the 15th fairway of the Kings Point Golf Course, located on the premises of a senior citizen retirement village. They found Herbert Merritt, 64, lying on the ground, with a “gunshot wound to his left ankle,” WPBF-TV reported, citing a Palm Beach County Sheriff’s Office arrest report.

Merritt told authorities he was walking his dog when Levine began yelling at him for having a dog on a golf course, WFOR-TV reported.

According to the arrest report, Levine began shooting at Merritt while he was running away, WPBF reported.

According to the television station, witnesses said they saw Levine kick Merritt in the head, then retrieve a golf club from his cart and strike the victim.

Deputies said they found shell casings on the ground on the fairway and two golf clubs apparently with blood on them.

Merritt was taken to an area hospital with injuries that were believed to be non-threatening, WPBF reported.

Levine remained in the custody of the Palm Beach County Sheriff’s Office, with bail set at $51,000, online booking records show.
