According to The Associated Press, the sentence imposed by U.S. District Judge Edward Davila was shorter than the 15-year penalty requested by federal prosecutors. Davila set her surrender date for April 27, and her lawyers will likely ask for Holmes to remain free during her appeal, according to Reuters.

Holmes, who was CEO throughout Theranos’ turbulent 15-year history, was convicted in January. Theranos had promised to deliver revolutionary technology that could scan for hundreds of diseases and other ailments with just a few drops of blood. But it never worked, the AP wrote.

According to The Mercury News, Holmes is the mother of a 15-month-old son and is currently pregnant.
