9 Investigates complaints against Access Lynx drivers

Following the arrest of an Access Lynx driver accused of sexually assaulting a women with the mental capacity of a child, Channel 9 began looking into other problems the public transportation company has had.

Police arrested Kelvin Nelson last week after they said he admitted to having sex with the woman on a bus. Police said the woman is 18 but has the mental capacity of a child.

Access Lynx is a complimentary public transportation service for those who can't use regular bus service because of a disability.

In 2010, police arrested Access Lynx diver Gustavo Riano after they said he attacked the wife of Fred Bonilla on a bus.

"He molested her, he groped her, tried to undress her," Bonilla said.

Riano has never been tried on the charges after being ruled not competent to stand trial.

Over the past year Channel 9 has reported on drivers fighting with passengers, making obscene gestures to drivers and leaving disabled clients behind.

Bonilla said he believes the company screening the candidates, MV Transportation, need to do better background checks.

Nelson passed that background check, but had criminal traffic charges lodged against him, the latest in 2012.

Riano had prior traffic troubles and domestic violence claims.

Bonilla said someone needs to monitor the drivers more closely.

"Sometimes they pick up people literally in their hospital beds and roll them in. They can't do anything. They're drooling on themselves. They can't talk. They can't communicate," Bonilla said.

A Lynx representative said that there have been terrible incidents with drivers, but said they are not representative of their drivers.

Of 723 Access Lynx complaints filed in the last five years, 311 were deemed legitimate, Lynx officials said.
