ORANGE COUNTY, Fla. — The attorney for Bessman Okafor is asking for a mistrial because of comments made by Okafor's co-defendant's lawyer in the Ocoee home invasion case Friday, WFTV found out.
WFTV also found out that there is an accusation that the victims talked about their testimony with each other, and witnesses who are victims are not allowed to do that.
The attorney for Okafor's co-defendant, Nolan Bernard, said she overheard witness William Harrington talk about the case.
Harrington denied talking about his testimony with anyone, but the judge found there was a sequestration violation and he admonished the witnesses to not discuss their testimony with one another.
The judge will address Okafor's attorney's call for a mistrial Friday afternoon.
The home invasion victims say it was Okafor's shaved left eyebrow and Bernard's cornrows that helped identify them as the gunmen who burst into the Ocoee home with guns last year, robbing them and tying them up.
"Bessman Okafor with the shaved eyebrows, 100 percent sure," said Brienna Campos.
Campos also said she was 100 percent sure the other was Bernard.
The other two victims were less sure about Bernard and one wasn't completely sure about Okafor.
The defense attorneys were challenging the identifications and Okafor's attorney accused Brienna Campos of being a drug dealer, because she admitted having 10 grams of pot in the house that she says Okafor and Bernard stole along with their cellphones and other belongings.
One of the victims said Okafor asked for Campos by name when they first burst into the house, but it is unknown how Okafor might have known her name,
"Ms. Campos, weren't you selling marijuana out of the home?" asked defense attorney Joseph Haynes Davis.
The prosecution called out an objection, which was sustained.
"No, that is not correct," Campos said.
