OSCEOLA COUNTY, Fla. — An Osceola County mother and father faced a judge Monday after their 2-year-old child was found alone in an active intersection late Saturday.
Johnny JeanBaptiste, 36, and Stacia McMillian, 32, each face one count of child neglect without bodily harm. A judge set bond at $2,500 for each parent Monday afternoon.
A Good Samaritan called 911 around 11:30 p.m. after finding the toddler running across Jones Road near Tanis Avenue in St. Cloud, according to charging affidavits.
The intersection has a posted speed limit of 30 mph, the affidavits said. The child was wearing only a diaper and tank top and was scared and crying but unharmed.
“We’re thankful for this Good Samaritan paying attention to the roadway and avoiding what could have been a very big tragedy,” Osceola County sheriff’s Capt. Kim Montes said.
Deputies canvassed the neighborhood to determine where the child lived. They found a small toy car outside a home on Talisi Loop, along with an open front door, diapers and children’s toys inside.
After receiving no response from anyone inside, deputies conducted a safety check and determined that the home was empty. Photographs inside the home helped investigators confirm that the toddler lived there, according to the affidavits.
A deputy called JeanBaptiste, but investigators said he hung up before the deputy could explain why he was calling. The affidavit said JeanBaptiste then appeared to block the deputy’s number.
A sheriff’s sergeant later reached JeanBaptiste, who said he was returning home. JeanBaptiste and McMillian arrived in a Toyota Corolla around 12:36 a.m., approximately 50 minutes after the responding deputy began investigating.
JeanBaptiste told investigators that he and McMillian had been arguing before they left to go to a store, according to the affidavit.
According to the affidavit, McMillian repeatedly laughed and declined to answer the deputy’s questions.
The deputy reported smelling alcohol on JeanBaptiste’s breath and seeing that his eyes appeared glossy. McMillian allegedly stumbled while leaving the vehicle and had slurred speech, glossy eyes and an odor of alcohol on her breath.
“We don’t know where they were,” Montes said. “We don’t know how long they had been gone because they were uncooperative with answering any questions.”
Deputies arrested JeanBaptiste and McMillian shortly after 1 a.m.
The Department of Children and Families was notified, and the child was released to relatives. The affidavit said the toddler had no apparent injuries or bruising.
A judge ordered that the parents have only supervised contact with the child while the case is pending.
